Terms of Service

These Terms govern your access to and use of EnglishGrammar.org, including free content, user accounts, newsletters, and paid Pro subscriptions (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.

The Services are operated by:

Eligibility and Accounts

You may use the Services only if you can form a binding contract under applicable law.

If you are under the age of majority where you live, you may use the Services only with the involvement and permission of a parent or legal guardian.

If you create an account, you agree to:

  • provide accurate, current, and complete information;
  • keep your login details confidential;
  • notify us promptly of any unauthorized access or suspected security issue;
  • be responsible for activity that occurs under your account unless caused by our breach.

Free Content and Pro Subscriptions

EnglishGrammar.org offers both free content and paid Pro content.

A Pro subscription gives you personal access to the premium content and features described at the time of purchase while your subscription remains active. Pro access is non-transferable and may not be shared with another person.

We may update the features, layout, or content of the Services from time to time, provided that we do not materially reduce the core paid features during a paid term except for legal, security, technical, or legitimate business reasons.

Orders, Pricing, and Contract Formation

Before you place an order, the checkout will present the essential commercial terms, including the price, billing interval, renewal terms, cancellation method, and any promotional conditions.

By clicking the button used to complete your purchase, you place an order with an obligation to pay.

Where Paddle is shown at checkout as the merchant of record or authorized reseller, the purchase transaction is between you and the applicable Paddle entity under Paddle’s Buyer Terms. Roth Media GmbH licenses and provides access to EnglishGrammar.org Pro under these Terms.

Pro access is activated after Paddle confirms the completed transaction and our systems provision access to your EnglishGrammar.org account.

Unless otherwise stated at checkout, Pro subscriptions renew automatically for successive billing periods until cancelled.

You authorize Paddle and its payment providers to charge the payment method you provide for the initial term and each renewal term at the price and frequency disclosed at checkout, unless and until you cancel.

Prices, currencies, applicable transaction taxes, and promotional terms will be shown at checkout. Paddle may calculate and collect applicable transaction taxes based on the product classification, your location, and applicable law. Your bank or payment provider may charge separate currency-conversion, foreign-transaction, or other fees.

We may reject, suspend, or cancel access in the event of an obvious pricing or technical error, suspected fraud, payment failure, legal restriction, or misuse of the Services. Paddle may also reject or cancel a transaction in accordance with its terms and legal obligations.

Payment Processing and Merchant of Record

Paid Pro subscriptions are sold and processed through Paddle, our merchant of record and authorized reseller. You purchase the Pro subscription from Paddle, while the Pro content and the licence to use it are provided by Roth Media GmbH.

Paddle is responsible for payment processing, applicable transaction-tax calculation and collection, receipts or invoices, refunds, chargebacks, and billing-related support in accordance with Paddle’s policies and applicable law.

Your purchase is also subject to Paddle’s Buyer Terms and Refund Policy.

We remain responsible for operating EnglishGrammar.org and providing access to Pro content. Your use of EnglishGrammar.org, your account, and Pro content remains governed by these Terms.

Your bank or card statement may show a charge from Paddle or PADDLE.NET.

Order Confirmation

Paddle or we will send an order or subscription confirmation to the email address associated with your purchase.

Cancellation

You may cancel your Pro subscription at any time through the Paddle customer portal, the subscription-management link in your Paddle receipt, or the Pro account area on EnglishGrammar.org.

Cancellation prevents future renewal charges. Unless applicable law requires otherwise, cancellation takes effect at the end of the current paid billing period and you will retain access to Pro content until that period ends.

Cancelling a subscription does not normally result in a refund for the current or any previous billing period.

We will not impose unreasonable barriers to cancellation. Where you subscribed online, an online cancellation method will be available.

Refunds

Refunds are governed by our Refund Policy, Paddle’s applicable Buyer Terms and Refund Policy, mandatory consumer law, and any additional conditions expressly disclosed at checkout.

Except where required by applicable law, where you validly exercise a statutory withdrawal or refund right, where Paddle approves a refund, or where we expressly state otherwise, subscription payments are non-refundable. We do not provide refunds or credits merely because a subscription was unused, partially used, or cancelled after a renewal payment had already been processed.

EnglishGrammar.org Pro does not include an unconditional 30-day money-back guarantee.

If a full refund is approved, your Pro access and licence to use Pro content will end immediately. The related subscription will be cancelled where applicable to prevent future renewal charges. You must stop using and delete any downloaded Pro materials, except where applicable law provides otherwise.

A partial refund does not by itself cancel the subscription or prevent future renewal charges. Unless we or Paddle tell you otherwise, Pro access will normally remain active after a partial refund while the subscription itself remains active.

If we permanently discontinue a paid subscription before the end of a paid term for reasons not caused by your breach, fraud, or unlawful use, we will provide a pro-rated refund or another legally appropriate remedy where required.

Price Changes and Plan Changes

We may change subscription prices or plans from time to time.

Any price change affecting an existing subscription will be communicated to you in advance before it takes effect for your next renewal. You will have the opportunity to cancel before the new price applies.

We may also send renewal, trial-ending, or price-change reminders where required by law or as part of our billing practices.

Failed Payments and Payment Disputes

If a payment fails, Paddle may retry the charge or request an updated payment method. We may temporarily retain Pro access while payment recovery is in progress, but we may suspend or cancel Pro access if the payment remains overdue or the subscription becomes paused or cancelled.

If a payment is reversed or made subject to a chargeback or other payment dispute, we may temporarily suspend Pro access while the matter is reviewed.

If a full refund is approved or a payment dispute is resolved in the buyer’s favour, Pro access may end immediately. If a chargeback or payment warning is later reversed and Paddle confirms that the subscription remains active, Pro access may be restored.

We may permanently terminate an account where a chargeback, payment dispute, or refund request is determined to involve fraud, account sharing, systematic downloading, refund abuse, or another material violation of these Terms.

Nothing in this section limits your lawful right to dispute an unauthorized or incorrect payment or to exercise mandatory consumer rights.

Free Trials and Promotions

We may offer free trials, discounted periods, coupons, or promotional pricing from time to time. Additional terms disclosed at the time of the offer will apply.

Unless otherwise stated, a free trial or promotional period may convert into a paid subscription at the end of the applicable promotional term, and the recurring price and billing schedule shown at signup will apply unless you cancel before renewal.

License and Permitted Use

Subject to these Terms and, for Pro content, an active subscription, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal, non-commercial, educational use.

You must not, without our prior written permission:

  • copy, reproduce, republish, sell, license, redistribute, or commercially exploit the Services or their content;
  • share Pro access, login credentials, downloaded Pro materials, or paywalled content outside your own personal use;
  • download, scrape, harvest, or extract all or substantial parts of the content at scale, whether manually, automatically, or by other systematic means;
  • retain or continue using Pro materials after an approved full refund, except where applicable law provides otherwise;
  • remove copyright, trademark, or other proprietary notices;
  • reverse engineer, interfere with, or circumvent technical restrictions, paywalls, or security features;
  • use the Services to train or improve machine-learning or artificial-intelligence systems using our content at scale;
  • upload or transmit malware, harmful code, or unlawful content;
  • use the Services in a way that violates applicable law or the rights of others.

Intellectual Property

All content on EnglishGrammar.org, including text, exercises, explanations, layouts, graphics, logos, databases, and software, is owned by us or our licensors and is protected by copyright, trademark, and other applicable laws.

User Feedback

If you send us comments, ideas, suggestions, or feedback, you grant us a non-exclusive, worldwide, royalty-free right to use and incorporate that feedback for any lawful purpose without any obligation to you.

Third-Party Services and Links

The Services may contain links to third-party websites, tools, or services, including Paddle’s checkout and customer portal. Third-party services are governed by their own terms and policies. We do not control and are not responsible for third-party content, terms, policies, or practices, except to the extent that responsibility cannot lawfully be excluded.

Availability and Changes

We may update, modify, suspend, or discontinue all or part of the Services at any time. We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.

We may make changes to content, features, pricing, plans, or technical requirements. Material changes to an active paid subscription will be handled in accordance with applicable law.

Suspension and Termination

We may suspend or terminate your access to all or part of the Services if:

  • you breach these Terms;
  • payment is overdue, reversed, fully refunded, or subject to a chargeback or payment dispute;
  • we suspect fraud, account sharing, refund abuse, systematic downloading, security risks, or unlawful activity;
  • we are required to do so by law, Paddle, a payment provider, a card network, or a competent authority.

An approved full refund may result in immediate termination of Pro access. A scheduled end-of-period cancellation will not normally end access until the current paid billing period expires.

We may also stop offering all or part of the Services. Where reasonably possible, we will provide advance notice for material changes affecting paid subscriptions.

Educational Nature of the Services

The Services are provided for general educational and informational purposes. We do not guarantee specific learning results, exam outcomes, or language proficiency gains.

Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. This includes implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

Nothing in these Terms excludes warranties, representations, or remedies that cannot be excluded under applicable law.

Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for willful misconduct, gross negligence, fraud, death, or personal injury where such exclusion is unlawful.

Subject to the preceding paragraph, to the fullest extent permitted by law, Roth Media GmbH will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunity arising out of or in connection with the Services.

Subject to mandatory law, our total liability to you for claims arising out of or in connection with a paid subscription will not exceed the total fees you paid for the affected paid subscription during the 12 months preceding the event giving rise to the claim.

Governing Law and Venue

These Terms are governed by the laws of Switzerland, excluding conflict-of-laws rules.

If you are acting in the course of a business, or if mandatory consumer law does not provide otherwise, the exclusive place of jurisdiction is Bern, Switzerland.

If you are a consumer, nothing in these Terms deprives you of mandatory rights or mandatory forum protections under the law of your habitual residence.

Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Material changes affecting registered users or active subscriptions may also be communicated by email or through the Services.
